Cell Phone Laws-How Far Should We Go?

Recently, I saw a graphic ad from Britain that warns against the dangers of texting while driving. It features four teen girls who end up in a fatal accident because the girl driving was distracted by her phone. In response to this and other efforts by like-minded activists, Texas has passed a law prohibiting cell phone use in a school zone, and another barring drivers under 18 from any cell use at all. Other states have passed other laws, including California’s move of outlawing any cell use while driving, which lead to the Governor Schwarzenneger’s wife getting caught breaking that very law.

I wanted to visit this issue and bring some common sense into a fight that seems to be lacking it. If we are going to combat distractions on the road, we shouldn’t post billboards on roadsides reminding drivers of cell use dangers. In New Hampshire, billboards are outlawed, because they are also seen as distractions, pulling your eyes off the road. I think if we’re going to fight the distraction in Texas, we should do it full force, fighting anything that could be the slightest distraction. Here’s my view of a safer Texas:

First we do away with billboards, as well as roadside signs, because pull the eyes off the road and the surrounding cars. Also the bumper stickers often used, having small print, cause desired readers to follow too close in order to see what they say, causing a high risk for rear-end accidents. Adjusting manual radios can cause a huge distraction if you can’t find that song you like, or want to find a new talk station. This causes as much of a distraction as cell phones.

Now cell phones are a whole other issue. These were created to allow communication in the event if an emergency, or for the convenience of calling your boss to tell them you’ll be late to a meeting, or get a reminder from the spouse of an errand or missing item on the grocery list. Now because phones are necessary for cars but create distractions, maybe we should use the technique behind GPS systems, which do not function while the car is in motion. To aid this, we should create cell phone use lanes on the sides of our roadways and highways where drivers can pull over and do what cell phones were made to, whatever their unique case may be.

Of course, the amount of government regulations and tax hikes, and spending that would be needed for all this is irrelevant, because security comes first, liberty coming second. This principle we showed with the PATRIOT Act, which allowed wire-tapping (no warrant necessary!) of civilian phone lines. We must do all we can to curb this man made problem, and turn our state into the safest it can be. There must be no barriers to the amount of action necessary here, as this is an urgent issue solvable by government regulation and spending. We see now in our nation that this technique is the only thing that works now, and it must be increased. If we don’t, our nation will fail. After all, aren’t we supposed to add as much regulation and debt as it takes to spend and regulate our problems to death?

Deeper Analysis: The 14th Amendment-Gays, Guns & Gitmo

In the previous post you can read Section 1 of the 14th Amendment of the Constitution of the United States. I wanted to clarify several issues using this section of our strongest founding document.

First is the trial of prisoners of war, particularly those at Guantanamo Bay and elsewhere. There are two words to describe those who are covered in this amendment: Citizens and Persons. Citizens is, of course, citizens of the United States. Person, however, means any human being, regardless of nationality. This says we are not to deprive these persons of life, liberty, and property without DUE PROCESS. I believe due process is required under our jurisdiction whether it be courts within the US or holding at a US base. All who are under any kind of American jurisdiction are entitled to due process by our constitution.

Also, we see property. This section states that no State shall make any law to take deprive any person of property without due process of law. I believe this means all property, from guns to land. The confiscation of property has gone too far in this country and this part of the Constitution must be observed once again if we are to have any chance of returning to that standard.

Finally, this section says any person within its jurisdiction is entitled to equal jurisdiction under the law. I believe this includes gays & lesbians. I believe this means that all LEGAL rights given to traditional couples should be given to gay & lesbian couples. However, the 1st amendment states that there shall be no law that goes against the freedom of religion, and I believe that also protects religious beliefs from being defined by Government or used thereby. So, marriage being a religious term, must not be applied by government to gay & lesbian couples, nor should it be used by government in any way. This is one way to give gay & lesbian couples their equal rights as persons and American citizens, but protects the religious definition and origin of the term marriage. Just as Jesus said-”Give unto Caesar what is Caesar’s, give unto God what is God’s”. Marriage is God’s term for a holy union between man and a woman, the legal aspects and rights are that of the State, and are defined and protected under our Constitution, just as the definition of marriage by God.

Proof that Abortion is Unconstitutional & a National Issue

Let’s look at the 14th Amendment, Section 1 of the Constitution of the United States:

All persons born or naturalized in the United Staes and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges of immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or poperty, without due process of law; nor deny to any person within is jurisdiction equal protection of the laws.

As we can see here, it clearly says “…nor shall any State deprive any person of life…”, and life begins at conception. Many, including Congressman Ron Paul, believe Abortion should be a state issue. But this amendment shows that no State is allowed to pass such laws.

 There was one friend who asked about the phrase that says “All persons BORN or naturalized in the United States…are citizens of the United States and of the State wherein they reside.” This is true, but the section regarding life says PERSONS, not CITIZENS which, in the context of this section of Amendment 14, have two different meanings. One means those who are citizens of this country, and persons refers to any human being.

This means Roe v. Wade is unconstitutional, as not one of the United States are allowed to create a law protecting abortions. This very amendment should be enough to show that, but I believe an amendment is made to further clarify.

I was looking at this amendment to study up for an upcoming Supreme Court decision on gun rights (McDonald v. Chicago), and I realized this. Hope this can show some more clarity in the future. And being an activist…I’ll be taking advantage of this new knowledge to fight for unborn life, speak for those who can’t themselves!

The People’s Plan: It’s Time for a Populist Revolution

Look at our current situation: There is little difference between the corporate and public sectors in America. AIG and the Government are sharing money, GM is 70% owned by the Government, and there’s taxpayer bailout funds going straight from the general fund made of social security funds and other “specified funds” of the people’s money. In this time of economic hardship and growing government control, the general public of these United States are completely left out. There’s been billions of dollars traded between CEO’s and politicians, but little to nothing has come to the aid of the American people. There is something wrong with this equation, and it’s time we did all we can to correct the fuzzy math.

The Tea Party movement has brought this issue to the forefront of American culture, but there has been a lot of confusion of what to do with all this energy. Do we empower the Republican Party? Do we move to alternatives like the Libertarian of Constitution Parties? I don’t think any of these are the solution. Instead, I think there’s a series of steps we must take to return our government to the rule of the governed, which is exactly what our great nation was founded on.

  • KICK THE CORPORATE BUMS OUT: If you look at the contribution records of any member of the Congress, House and Senate alike, you will see that contributions by everyday Americans are overshadowed by those of corporations and special interest groups. This is driving our lawmakers to make the decisions they do, and to turn a blind eye when the bills they pass do infinite damage to the American people and the future thereof. We can no longer afford the misplaced trust we have in them, and it’s time we used our unique form of the democratic process to our full advantage and elect new members of both Congressional chambers.
  • PUT CANDIDATES TO THE TEST: We must put our candidates through a tough test of loyalty to the United States Constitution and the American people’s best interests. No longer can we judge our candidates by the number of endorsements or the rhetoric they spread. We must put them through a test they cannot avoid, one that is pass or fail, no ifs, ands, buts, or “good question’s” about it. Our current lawmakers gained office because of their ability to pull the wool over concerned and vulnerable eyes. Now we must be prepared to threaten their jobs rather than them challenging our fears.
  • END THE DYNASTIES: Term limits on the congressional level are a must. No longer can we afford to see politicians get elected once and buy their way through every reelection campaign after. We have lawmakers who have been reelected time and time again just because they can pull in the most funds and give the best performance.  With term limits we will not spend most of our time fighting repeated, failed agendas, such as universal health care and gun control. No longer will we see the same bills over and over, and get the same idle results from the Congress. We need a fresh start every now and then, to get fresh action going to help move America forward.
  • REFORM THE TAX SYSTEM: We currently live under a discombobulated, overdone, and oppressive tax system that penalizes nearly every aspect of productivity and prosperity in American life. You’re taxed on your paycheck, and taxed on your benefits, and on your inheritance, and even on the very existence of your small business. We need to reform our tax system so that it is taken from our spending, not from our earnings and living wages. A national flat tax is not only more comprehensive than the discombobulated and scattered code we currently pay into, it would bring in more revenue, as it would be more broad based. This way, those who struggle to feed families with their hourly wages will no longer have to look at how many hours they worked go into a government general fund that is trillions of dollars in debt. Also, there should be a prebate system that prevents those struggling families from facing an issue of affording essential products. Overall, this system would empower American productivity while providing sufficient funds to run a decent federal government.
  • CUT GOVERNMENT DOWN TO SIZE: Our government, when compared to its roots, is unrecognizable. We have a Central Intelligence Agency that conducts warrantless wire tapping on the average American people, and an executive branch which is inflated by misplaced authority and cabinet positions that are not put through the appropriate confirmation process, called “Czars”. We have numerous departments such as the Department of Education running programs that under the 10th Amendment are powers guaranteed to the states and the people. The government must be temporarily dismantled and re-founded strictly within the bounds of the United States Constitution, and strengthen that document to prevent this government inflation from happening again.
  • END THE FED-STOP THE THEFT:  Counterfeit machines are the target of the United States Secret Service, but only when in possession of American citizens. Our country is drowning in a $10 trillion+ debt, and the Federal Reserve is attempting to create a solution by printing page after page of currency and throwing it at those we owe for programs we cannot now and never could afford. This strongly devalues the dollar, creating massive inflation in our struggling economy. The Federal Reserve, America’s centralized bank, has been devaluing our money for far too long, and it’s time we put an end to it for good, and let interstate trade bring our dollar back to its strong reputation, and bring our economy back out of the black hole it’s fallen into.

This plan is created to return the Federal Government to the consent of the governed, and take it down to size. America was founded to be a nation run by the people, declaring independence from a nation run by a royal family. We are now run by the corporations and political establishment, a mix that is fatal to individual liberty and American prosperity. Join me in working hard to put this plan forward, and take our nation back from the most elite in our society.

The Conservative Cause Across the Atlantic

The cause for smaller government, stronger familiy values, and a safer economic environment for businesses is not only full of momentum here, but is also moving forward at full speed in Britain. The general election is next Spring and, if the Conservative Party wins out, it could change the momentum of democratic socialism across Europe, which will ultimately translate to a boost in the movement against the Democratic Party’s socialist agenda here in America. With Gordon Brown toppled, Obama will have no one to go to for help in moving his Labour-style agenda along. Here is the link to the speech by David Cameron, leader of the Conservative Party, at the Conservative Party Conference of 2009. I wish this guy could be our President, and that Republicans were this energized and straight-forward!

Statement on President Obama’s Nobel Peace Prize.

Kevin released the following statement on President Obama being awarded the Nobel Peace Prize: 

The value of the Nobel Peace Prize has been tarnished after it was awarded to President Obama, who was President for under 2 weeks when he was nominated, and accomplished nothing to deserve it. M…any of the nominees are much more deserving, and the Prize must be honored much higher in the future, as it can be a great incentive for peace and justice all over the world.

Announcing: The Activist Report

Tonight at the Ellis County Conservatives meeting, I announced the premiere of my new online radio show, The Activist Report, which will air this Saturday night, October 3, at 9 p.m. CDT. This show will be a voice for those devoted to the fight for liberty against the oppressive government in Washington D.C. This show will follow the following principles, from the Declaration of Independence:

We hold these truths be self-evident: That all men are created equal; that they are endowed by their Creator with certain unalienable rights; that among these are life, liberty, and the pursuit of happiness; that, to secure these rights, governments are instituted among men, deriving their just powers from the consent of the governed; that whenever any form of government becomes destructive of these ends, it is the right of the people to alter or abolish it, and to institute new government, laying its foundation on such principles, and organizing its powers in such form, as to them shall seem most likely to effect their safety and happiness.

Our government has become far more oversized from the constitutional boundaries set up by our founding fathers, and it’s time we did something about it. The government we have now is far too out of shape to be repaired, so I believe we need to completely reform it, starting with reinstating the constitution. Repealing departments and taxes will not do the job-we need a total constitutional overhaul that is as radical as the movement that created this country in the very beginning. This show will be a voice for that movement, and for accountability of those we have chosen to elect, as well as ousting those who have chosen not just to ignore, but to defy the people of this great nation.

I will host this new show, and it will feature discussion with callers as well as special guests from time to time. This Saturday’s show will be a special 2-hour premiere event, which I will use to explain the future of the Report, and why this show is so important to the movement for liberty.
